express contrary notice (all services offered through the digitalempire Website or the digitalempire App,
collectively the “digitalempire Services” or the “Services”).
The digitalempire Terms constitute a binding and enforceable legal agreement between digitalempire.com Ltd., its
affiliated companies and subsidiaries worldwide (“sitish” or “we”) and you in connection with
use of any digitalempire Service - we therefore invite you to read them carefully.
YOUR INTELLECTUAL PROPERTY
Since between Sitish and you, it is up to you to own all intellectual property relating to
your User Content and any other material created by you, including any designs, images,
animation, video, audio file, font, logo, illustration, composition, work, code, interface, text and
literary work, digitalempire does not claim any ownership rights over your content. For the sole purpose of granting you
the service, You know and accept that we will need to access, upload and/or
copy your User Content to our platform, including cloud and CDN services, to make
display settings, to duplicate for backup and carry out any other activity and/or
use technology to operate our services, as we deem appropriate.
CONFIDENTIALITY
Certain parts of the sitish Services (including certain third party services made available through them,
as explained in more detail in Clause 9 below) require or involve sending, collecting
and/or use of certain personally identifiable or identifying information. In
individual and in the context of access to or use of the digitalempire Services, digitalempire and these third-party Services
may collect, use and access certain data relating to Users and Users
Purposes, including activities or navigation carried out by Users and End Users through
the digitalempire Services and/or User Platforms. We invite you to regularly read our
Privacy Policy as well as the policies regarding each of these Third Party Services, to obtain
a description of this data collection and use practices.
SERVICE FEES
The use of certain digitalempire services may be conditional on the payment of specific fees including the
amount is determined by digitalempire in its sole discretion (“Paid Service” and the “Fees”, respectively).

INVOICES

and depending on the country indicated in your billing address. It will be made available to you via your
User Account and/or by email. For the purpose of issuing the Invoice, you may be required to provide certain Personal Information (as this term is defined in the Privacy Policy).

GUARANTEE AND REFUND
If you are dissatisfied with any of the digitalempire Services subject to Fees as to the period of use or a
registration commitment, as part of the initial purchase of this service, you have the opportunity to notify
cancellation, without particular reason, within fourteen (14) days following the first order, or
activation of this digitalempire service (the “Refund” and the “Refund Period”). THE
Refund only applies to the initial purchase of Sitish Services as part of an upgrade
a free site, by purchasing a Premium Offer (as offered on the sitish Site). THE
Refund does not apply to any additional purchases, upgrades, modifications or
renewal of sitish Services.
CHARGE REJECTION
If, at any time, we notice a refusal, chargeback, or other opposition to payment of Fees on
your satish Account (“Chargeback”), this will be considered a violation of your obligations of
payment hereunder, and your use of the digitalempire Services may automatically be
suspended or terminated.
In the case of a Chargeback, your User Account may be blocked without the option of
redemption or reuse, and all data contained in this User Account, including
domains, applications and Third Party Services may be canceled and be
subject to loss of capacity (as defined in Article 6.3 below).
CANCELLATION BY THE USER
You may stop using and request to cancel your User Account and/or digitalempire Services at
at any time, in accordance with the instructions available in the digitalempire Services. Date and time
effective for such cancellation are those at which you have completed the cancellation process on
the sith Services, and the effective date of termination of the Paid Services will be that of the end of the period
subscription which relates to it.
THIRD PARTY SERVICES
The sith Services allow you to contract and obtain certain services, products and tools
third parties to improve your User Platform and your overall user experience, in particular,
limited to this, companies allowing the registration of domain names, applications and
third-party widgets offered via the digitalempire Site (including the digitalempire App Market), Third-party Licensed Content,
multimedia content distribution services, payment service providers
E-commerce, tangible product sellers, third-party designers who can help you
with your User Platform, etc. (collectively, “Third Party Services”).
ENTIRE AGREEMENT
These Terms of Use, as well as the Sitish Terms and any other legal or pricing notices
provided to you by digitalempire, shall constitute the entire agreement between you and digitalempire concerning the subject matter of the
herein, and supersede all agreements, arrangements, promises, conditions, negotiations, pacts
or statements, past or present, written or oral, between you and sitish, including those made by or
entered into with one of our respective representatives, with respect to any Sitish Service. You accept
also not to rely on any promise, inducement, instruction, disclosure or duty
of digitalempire Disclosure by accepting the digitalempire Terms.
